Item Description:
Vacation of excess right of way adjacent to CSAH 25 in St. Louis Park
Resolution:

BE IT RESOLVED, that 2,952 square feet of highway easement and 2,118 square feet of ditch easement located adjacent to County State Aid Highway (CSAH) 25 in the city of St. Louis Park be declared excess right of way and vacated; and that said excess right of way is legally described as:

  

Legal description of the vacation of a portion of the highway easement Parcels 137, 138, 139, and 140 created in Doc. No. 2021414 and partially assigned to Hennepin County per Doc. No. 6471501 

 

Those parts of Lot 13 through 16 inclusive, Block 2, Mazey and Langan's Addition to St. Louis Park, according to the recorded plat thereof, Hennepin County, Minnesota lying northerly of a line hereinafter described as Line 1 and southerly and easterly of a line hereinafter described as Line 3:  

 

Line 1 is described as beginning at the point of intersection of a line run parallel with and distant 100 feet southeasterly of Line 2 described below with the south line of said Lot 15; thence run northeasterly parallel with said Line 2 to a point distant 100 feet southeasterly (measured at right angles) of a point on said Line 2, distant 866.3 feet northeasterly of its point of beginning; thence run northeasterly to a point distant 40 feet southeasterly (measured at right angles) of a point on said Line 2, distant 1016.3 feet northeasterly of its point of beginning; thence run northeasterly parallel with said Line 2 for 50 feet and there terminating; 

 

Line 2 is described as beginning at a point on the east line of Lot 2, Block 4, Lewiston Park, according to the recorded plat thereof, said county, distant 1.7 feet southerly of the northeast corner thereof; thence run northeasterly at an angle of 78 degrees 33 minutes 00 seconds from said east line (measured from north to east) for 94 feet; thence deflect to the left on a 01 degree 00 minute 00 second curve, having a radius of 5729.65 feet and a length of 1310 feet; for 972.3 feet and there terminating;  

 

Line 3 is described as commencing at the north quarter corner of Section 6, Township 28, Range 24, said county; thence South 00 degrees 26 minutes 06 seconds West, assumed bearing along the north - south quarter line of said Section 6, a distance of 1092.89 feet to the point of beginning of the line to be described; thence South 73 degrees 14 minutes 47 seconds West 10.28 feet; thence southwesterly 220.70 feet along a non-tangential curve concave to the northwest, having a radius of 5802.14 feet, a central angle of 02 degrees 10 minutes 46 seconds, and a chord bearing of South 70 degrees 30 minutes 32 seconds West; thence South 67 degrees 02 minutes 58 seconds West 65.29 feet; thence South 00 degrees 20 minutes 22 seconds East 298.91 feet, and said line there terminating. 

 

Legal description of the vacation of an easement for County Ditch No. 14 as created by stipulation on file in Torrens Case No. 15365 

 

An easement for County Ditch No. 14 over part of the following described property: 

 

That part of the Southwest Quarter of the Northeast Quarter, Section 6, Township 28, Range 24, described as beginning at the Northwest corner of said Southwest Quarter of the Northeast Quarter; thence South along the West line thereof 288.7 feet; thence East to a point on the Northerly right-of-way line of the Minneapolis and St. Louis Railway Company, distant 46 feet from the intersection of said right-of-way line with the West line of said Southwest Quarter of the Northeast Quarter as measured along said right-of-way line; thence Northeasterly along said Northerly right-of-way line to its intersection with the extension South of the East line of Monterey Avenue; thence North along the extension of the East line of Monterey Avenue to the North line of said Southwest Quarter of the Northeast Quarter; thence West along said North line to the point of beginning. 

 

Said easement area is described as follows: 

 

Beginning at a point on the West line of said Southwest Quarter of the Northeast Quarter of Section 6, Township 28, Range 24, distant 180 feet South of the Northwest corner thereof; thence East at a right angle a distance of 20 feet; thence South parallel with said West line to the South line of said above described unplatted land; thence West along said South line to the West line of said quarter-quarter section; thence North along said West line to the point of beginning. 

Background:

In preparation for future development, the city of St. Louis Park acquired all fee title ownership of the property south of CSAH 25 between Beltline Boulevard and Monterey Avenue South, north of the Southwest Light Rail Transit (SWLRT) Beltline Boulevard Station. In addition, the SWLRT Project plans to construct several improvements which include removing the CSAH 25 frontage road, installing a new “backage” road north of the SWLRT station, and constructing a right-in only from CSAH 25 to Monterey Avenue South. The city and county have also developed a concept with new multi-modal facilities along CSAH 25 east of Highway 100. These changes require portions of CSAH 25 right-of-way to be vacated. 

 

St. Louis Park has a Purchase Agreement with Sherman Associates to develop the site into a mixed-use, mixed-income, transit-oriented development. Sherman Associates, with the city’s support, submitted an easement/right of way vacation application for the portions of CSAH 25 between Beltline Boulevard and Monterey Avenue and applied for a preliminary and final plat. The city submitted applications for various easements including the formal vacation of the CSAH 25 frontage road. These applications meet county requirements and staff has determined that the highway and ditch easements identified are no longer needed for the county’s current or future highway needs.  

 

Current Request: This request is for authorization to declare excess right of way and vacate approximately 2,952 square feet of highway easement and 2,118 square feet of ditch easement located adjacent to CSAH 25 as legally described above to facilitate the re-platting of the area for development in the city of St. Louis Park as requested by the developer, Sherman Associates. 

 

Impacts/Outcomes: Approval of this request will allow for development of the site and will release interests no longer needed by the county. This request supports the county’s climate action and disparity reduction efforts by facilitating the construction of mixed-use transit-oriented development near the SWLRT station.
