BE IT RESOLVED, that the County Administrator be authorized to negotiate a work authorization under Master Agreement PR00002153 with Bolton & Menk, Inc. to provide final design engineering services for the County State Aid Highway (CSAH) 5 (Minnetonka Boulevard) reconstruction project from Trunk Highway (TH) 100 to CSAH 17 (France Avenue) in the city of St. Louis Park, county project (CP) 2168100, during the period September 27, 2022 through December 31, 2024, in an amount not to exceed $1,200,000; that following review and approval by the County Attorney’s office, the Chair of the Board be authorized to sign the authorization on behalf of the county; and that the Controller be authorized to disburse funds as directed; and
BE IT FURTHER RESOLVED, that the County Engineer is hereby authorized to submit a formal variance request to the Commissioner of the Minnesota Department of Transportation according to Minnesota Administrative Rules for State Aid Operations Chapter 8820, part 8820.9995 (Minimum Off-Road and Shared Use Path Standards) for State Project 027-605-033, CP 2168100, to construct a new shared use path along CSAH 5 with a shoulder/clear zone of 1.5 feet in lieu of the required 2 feet minimum, as stipulated; and
BE IT FURTHER RESOLVED, that upon approval of the requested variance by the Commissioner of the Minnesota Department of Transportation, the Hennepin County Board of Commissioners hereby indemnifies, saves, and holds harmless the State of Minnesota and its agents and employees of from claims, demands, actions, or causes of action arising out of or by reason of the granting of the variance, and further agrees to defend at its sole cost and expense any action or proceeding commenced for the purpose of asserting any claim arising as a result of the granting of this variance.

| | | | | | | | Background:
Hennepin County, in coordination with the City of St. Louis Park, plans to reconstruct Minnetonka Boulevard from TH 100 to France Avenue (CP 2168100). The project will reconfigure traffic lanes, replace traffic signals, upgrade pedestrian ramps, install accessible pedestrian signals, and construct new sidewalks, storm water structures, and streetscape. complement the Green Line Extension LRT Project by improving connections for people biking, walking, and rolling to the Beltline Boulevard and West Lake Street light rail stations.
In January 2021, through a competitive selection process, the county contracted with Bolton & Menk, Inc. to provide preliminary design engineering services for the project, CP 2168100, at county cost not to exceed $499,987 under Master Agreement PR00002153.
Substantial public engagement has been completed for the project, including posted signage, surveys, online map for commenting, and an open house at the St. Louis Park City Hall. Improvement options informed by this engagement were created that meet the project goals and address the community needs. Final design engineering services are now needed to complete the project.
The requested work authorization with Bolton & Menk, Inc. is to complete the final project design at a total county cost not to exceed $1,200,000. The project includes a 16% Small Minority Business Enterprise (SMBE) goal. Bolton & Menk, Inc. is partnering with SMBE firms to meet and exceed that goal. Adequate funding for this design work is available in the project budget.
In addition, a variance for the project is requested to minimize private property impacts. This formal variance request from the Minnesota Department of Transportation will allow the shoulder width to be reduced from the required 2 feet (minimum) to 1.5 feet.
Project construction is anticipated for spring 2024 with substantial completion in fall 2025.
Current Request: This request seeks authorization to negotiate a work authorization under Master Agreement PR00002153 with Bolton & Menk, Inc. for final design engineering services for Minnetonka Boulevard reconstruction project at county cost not to exceed $1,200,000, CP 2168100. Additionally, this request is for authorization to seek a variance from Minnesota Administrative Rules for State Aid Operations Chapter 8820, part 8820.9995 to allow a reduction of the required shoulder/clear zone width along the new share use paths to 1.5 feet in lieu of the required minimum of 2 feet as stipulated.
Impacts/Outcomes: This project aligns with Hennepin County’s Mobility 2040 goals, climate action and disparity reduction efforts by preserving and modernizing our transportation system and improving accessibility and safety for people walking, biking, and rolling the several regional trails. This is especially important as the project is in an area that includes a relatively high percentages of no-vehicle households and people with limited mobility.
