BE IT RESOLVED, that the executive director is authorized to negotiate Amendment 3 to Cooperative Funding Agreement A166179 with Metropolitan Council (Council Document #16I055) for the METRO Green Line Extension (Southwest LRT) Project (CP 1000899) Project Development Continuance and Engineering phases, extending the contract period from May 31, 2018 to August 31, 2018, and increasing the not to exceed budget authority amount by $4,219,863 for a new total not to exceed amount of $67,489,145, provided that no amounts may be expended or encumbered for costs pursuant to pre-award authority or a letter of no prejudice except upon prior approval of the Hennepin County Regional Railroad Authority (HCRRA) Board.
BE IT FURTHER RESOLVED, that Amendment 3 will incorporate the following conditions, which shall be in addition to other conditions in the Agreement: all project contingency funds shall be managed pursuant to the Executive Change Control Board Operating Procedures attached as Exhibit A; the additional project considerations, as attached in Exhibit B; and project decision making will proceed as set forth in Exhibit C.
BE IT FURTHER RESOLVED, that following review and approval by the Office of the County Attorney, the Chair be authorized to sign the amendment on behalf of the authority; and that the Controller be authorized to disburse funds as directed.

History: Resolution 16-HCRRA-0037 authorized Cooperative Funding Agreement A166179 with the Metropolitan Council for the provision of up to $53,134,401 for HCRRA Southwest Light Rail Transit (SWLRT) (CP 1003570) Project Development Continuance and Engineering Phases (PDC/ENG phases). Additionally, Agreement A166179 identifies up to $45,884,127 of the not to exceed amount, to be reviewed and encumbered quarterly by the HCRRA, for pre-award authority and Letters of No Prejudice construction activities.
Resolution 17-HCRRA-0029 authorized Amendment 1 to Agreement A166179 extending the contract date from July 31, 2017 to March 31, 2018, and increasing the HCRRA’s budget authority for the agreement by $6,765,599, for a new total not to exceed amount of $59,900,000.
Resolution 18-HCRRA-0012 authorized Amendment 2 to Agreement A166179 extending the contract date from March 31, 2018 to May 31, 2018, and increasing the HCRRA’s budget authority by $3,369,282 for a new not to exceed amount of $63,269,282, and increasing the HCRRA’s pre-award budget authority by $5,073,637 for a new pre-award not to exceed amount of $50,957,764.
Extending the contract date from May 31, 2018 to August 31, 2018, will require increasing the HCRRA’s budget authority by $4,219,863 for a new total not to exceed amount of $67,489,145. This amount includes funds for HCRRA’s share of the purchase of the Bass Lake Spur rail corridor from Canadian Pacific Railway, the closing on which will not move forward except subject to certain conditions, including a favorable decision at the federal Surface Transportation Board.
Current Request: Amendment 3 to Cooperative Funding Agreement A166179 with the Metropolitan Council for the METRO Green Line Extension Project (CP 1000899) PDC/ENG phases, extending the contract term from May 31, 2018 to August 31, 2018, increasing the not to exceed budget authority by $4,219,863 to a new total of $67,489,145, with certain conditions.
Impact/Outcomes: Amendment 3 to Agreement A166179 will support ongoing the engineering work for the METRO Green Line Extension Project in preparation for the Metropolitan Council's application for a full funding grant agreement.
